                                                           Vacation Rental Agreement

This agreement constitutes a contract between the Guest(s) and Mountain Cabin Resort.  Please read your Vacation Rental Agreement before you begin your vacation. Any monies received by Mountain Cabin Resort for occupancy of vacation property indicated the acceptance of the terms of our Vacation Rental Agreement in full. All policies are strictly enforced. It is the responsibility of all guests (and members of their party) to be familiar with all policies pertaining to rental. At the time the reservation is made our cancellation policies come into effect, please see cancellation policy below. THIS AGREEMENT made this ___ day of ____________ 2010 between Mountain Cabin Resort, ("Owner"), and ___________________(collectively called "Guest") of our vacation home “Mountain Cabin Resort”. The term “agreement” includes Rental Agreement, all pages. The term “Guest”, “You”, and “Your” shall include Guest, their family members, minors, extended family, their heirs, guests, successors, representatives, friends, invitees, and other persons on the Property during Guest’s occupancy. The term “Owner”, “We” shall include owners their heirs, representatives, agents, employees. The term “Property”, “Cabin”, “home”, “Mountain Cabin Resort” in this agreement shall include the house located at 870 Bolster Court, Ranger, Georgia 30734, the front and backyard, decks and the entire property.

 CHECK-IN TIME IS 2:00 PM - Check in time is 2 p.m. Key will be left outside in lock box for guest. Guest is free to call owner with any questions at any time before/during their stay.

 CHECK-OUT TIME IS 11:00 AM - Check out time is 10 a.m. Guest must leave the key in the same lock box make sure it is well closed. All doors must be locked, and all appliances turned off. Propane to fireplace must be left in off position.

 RESERVATION REQUIREMENTS – $200.00 total rental fee required in advance to hold reservation. We accept Visa, MasterCard, Money Orders and Checks drawn on U.S. banks. (If securing with a check, it must be received within 3 days after booking has been made or the reservation will be canceled. We do not accept checks on reservations made less than 30 days before arrival. Balance is due 14 days prior to check in by credit card or money order (no personal checks). Please reference reservation dates when sending check or money order. Upon receipt of deposit confirmation and directions will be mailed, faxed or emailed to Guest. 

SECURITY DEPOSIT – The security deposit of $200.00 can be paid in the form of personal check drawn on U.S. banks (checks must be received 30 days prior to arrival), cashiers checks, money order, cash, or credit card, along with a valid drivers license, could be faxed, mailed or e-mailed. This security deposit will be returned within one week of the departure date, provided there are no missing items, breakage or damage to the premises and/or contents, cleaning costs, other than those normally incurred in connection with the occupancy of the premises. Guest(s) acknowledges Agent(s) authority to charge Guest(s) Credit Card for damages to the unit occupied by the Guest(s) and/or his/her Guest(s). Each Guest will be financially responsible for damage done to the property beyond normal wear and tear. If there is damage to a property or its’ property within, after the Guest(s) departure, the Guest will be notified of any excessive cleaning needed or damages made and the amount will be charged to their credit card or deducted from the above mentioned $200.00 damage deposit. The security deposit will be refunded to Guest, less any damages or excessive cleaning charge, within 7 days of your departure. Guest(s) will be responsible for any damage caused by Guest(s), guest(s) family, guest(s) invitees, and guest(s) guest(s). 

 CANCELLATION - Guest may cancel in writing 30 days prior to check in date and receive a full refund. Cancellations within 30 days or less to check in date will forfeit all deposits and payments. We recommend that you purchase trip cancellation insurance. No-shows, late arrivals, change in number of persons, and early departures after arrival are non-refundable. In the event that owner is able to rent the property to another party for the same period and amount, then a refund may be issued to guest minus a $25 fee to cover credit card company’s fees. In the event the property is not available to be occupied, (natural disaster, fire, acts of God) and owner must cancel your reservation, owner’s liability shall be limited to fully refunding the guest his/her deposit or monies paid to owner. We do not give refunds based on weather, as we do not control the weather.

RESERVATION CHANGE FEE - All reservations that need date changes are subject to a non-refundable $30.00 rescheduling fee per change. All changes must be done prior to cancellation period expiration. 

 NO SHOW/EARLY DEPARTURE POLICY – Agents are not responsible for Guests inability to arrive or if Guests chooses to depart early for any reason, or if members of Guests party do not show up. NO REFUNDS OR REBATES will be offered.

RETURNED CHECKS - A $35.00 service charge will be incurred for any returned checks. 

 KEYS - All keys must be left inside the lockbox upon departure. Guest(s) are issued one set of keys at check-in. As this is a privately owned property, Guest(s) are responsible for lost-keys. The property must be re-keyed in the event that keys are lost, misplaced, or not returned. The Guest(s) will be responsible for cost of this procedure. Please call point of contact at any time with any lost key issues immediately.

SATELLITE/CABLE TELEVISION - We do not guarantee any programs, events or reception.  Rental properties are individually owned and Agents cannot guarantee TV channel availability. Rental properties do not offer premium packages, i.e., Movie Channels, Sports Channels, Pay Per View, etc. Agents cannot under any circumstance activate premium channels. NO EXCEPTIONS! NO REFUNDS OR REBATES will be offered. 

LONG DISTANCE TELEPHONE CALLS – Cabin telephones calls are to be used for local calls and (911) only.  For long distance calls use a prepaid calling card.  If guests calls long distance there will be a long distance charge plus a $5.00 service charge per incidence. Majority of Cell-phone coverage is reliable in the cabins, however signal may weaken in the surrounding area.

SMOKING - Smoking is NOT permitted in property. Outside smoking is permitted but please do not litter. Failure to obey this rule will result in loss of security deposit and/or charge to credit card. 

 ALCOHOLIC BEVERAGES - No drinking of alcoholic beverages by persons under the legal age of twenty-one (21) is allowed. Should a Guest(s) or guest of Guest(s) be arrested for underage drinking at the rental unit property or should Agent(s) observe a Guest(s) or guest of Guest(s) under the age of 21 drinking alcoholic beverages, this rental agreement may be terminated and the Guests evicted at the option of the Agent(s). Illegal drug use is strictly prohibited. Kegs are not permitted on any property. 

 PETS - You acknowledge that NO PETS are allowed in or on the premises. IMPORTANT: NON COMPLIANCE WILL RESULT IN IMMEDIATE EVICTION AND LOSS OF ALL RENTS AND SECURITY DEPOSITS! 

 HOMES ~ FURNISHINGS ~ EQUIPMENT ~ ETC. - Under no circumstances are furniture, bedding, mattress pads, utensils or any other property supplied with the rental property to be removed from premises. Moving of furniture is prohibited; any evidence of such will result in a charge against Guest(s) security deposit. Loss of these items, as well as damage to the property or furnishings in excess of normal wear will be charged to Guest(s), the renter. Certain areas in each rental property are locked for the OWNERS personal storage and are not included in this rental. 

 LINEN - A basic supply of linen is provided in each property. Bed linen and bath towels are not changed during your stay. 

 CLEANING REQUIREMENTS – Guest(s) are required to leave the property in the same general condition it was when Guest(s) arrived. Dishes should be cleaned and put away but beds do not need to be made. We will dust, vacuum, sanitize, and clean all towels and linens upon your departure. If additional cleaning is required, appropriate charges will be deducted from your security deposit. Guest(s) is responsible for any damage, abuse, excessive cleanup requirements, or loss caused by any member of Guest(s) party to the property or its contents during Guest(s) occupancy. Inspectors walk through property after checkout to ensure the property is left in good order. We will make that final determination of the necessity of any charges to Guest(s). Maid service and other cleaning arrangements during your stay may be available for an additional charge. 

 CHECK OUT PROCEDURES - The following items must be complied with before check out or Guest(s) shall forfeit the security deposit:

(a). Dishes, Pots, Pans, Silverware, and Utensils must be washed; dried and put away and the stove/oven shall be left in a clean condition.

(b). Refrigerator should be left clean and free of food.

(c). Windows and doors must be left closed and locked with the air conditioner on 80 degrees or heat on 64 degrees depending on the outside temperature.

(d). All trash to be put in garbage can close tightly outside on deck. When full trash must be taken to main gate to be thrown away on (Hwy 136)

(e). All litter, cigarette butts, etc. must be picked up from the yard, front and back, and placed securely in trash bags.

(f). Property should be left neat and in order (same condition it was when Guest(s) arrived).

(g). Check all propane gas grills that they are turned off. 

 REPAIRS ~ SERVICE CALLS~ REFUNDS – We cannot guarantee against mechanical failure of heating, air conditioning, TVs, Satellite Receivers, DVDs, or other appliances/electronics. Please report any inoperative equipment immediately. We will make every reasonable effort to have repairs done quickly and efficiently.

Should a repairperson make a call to a unit and find that the equipment is in working order and the problem was due to the Guest(s) oversight or neglect, the charge for service will be the Guest(s) responsibility. No refunds or rent reductions will be made due to failure of appliances or equipment. PLEASE do not put off notifying us immediately as it could hinder us getting the repair done quickly!  Guest(s) understands and agrees that we may enter the rental property at any time for the purpose of making needed repairs. Please keep in mind that the property has been reserved and held for you and that others may have been turned away. Refunds or rate adjustments are not made for any inconvenience due to construction, road repair, etc. 

 ACTS OF GOD/CONSTRUCTION NOISE - Owner shall not be liable for events beyond their control which may interfere with Guest(s) occupancy, including but not limited to Acts of God, acts of governmental agencies, fire, strikes, war, inclement weather and construction noise from nearby sites. 

 GRAVEL ROADS - Roads leading to cabin are unpaved, mountainous and sometimes bumpy. We are not responsible for road conditions. Special vehicles are not necessary however it is not recommended that you use low riding vehicles or sports cars.

 BEARS, DEER, INSECTS & REPTILES - Guests are in the mountains and woods. Depending on the time of year you may encounter wildlife and insects. Guests are encouraged to dress appropriately and bring insect repellant for outdoor activities. Please do not feed the wild life, and always provide adult supervision to any children under 18 years of age.

 HOUSE PARTIES – ARE NOT ALLOWED! Rental Guest understands that Agent(s) will accept families, married couples, and responsible adults over the age of 21 ONLY. Guest(s) agree that more than the number of people stated on the lease shall not occupy the premises. If the unit is occupied by more than the number of people stated, it will result in loss of total rent, security deposit and/or additional charge to credit card. Occupancy in use of premises shall not be such as to disturb or offend neighbors. The use of firearms or fireworks is strictly prohibited. Guest(s) certify that they have read carefully the limitations placed on the number of persons permitted to occupy the premises, and agree to abide by such limitations: if not, Guest(s) will be asked to vacate the property which will result in loss of total rental and security deposits with no refund. 

 RIGHT OF ENTRY - Guest(s) agree that the Owner(s)/Owner(s) Agent reserves the right to enter the rental property anytime to investigate disturbances, check occupancy, check for damage, to make such repairs, alterations or improvements thereto as Owner(s) may deem appropriate. 

 EXPEDITED EVICTION - A material breach of this Agreement by Guest(s), which, in the sole determination of the Owner, results in damage to the Premises, personal injury to Guest(s) or others, a breach of the peace, a nuisance to others, or a violation of criminal law or local code, shall be grounds for termination of Guest(s) tenancy. Violation of any of the rules contained here in will result in IMMEDIATE EVICTION and forfeiture of rent and security deposit. If the tenancy created hereunder is for 30 days or less, the expedited eviction procedures set forth in the Vacation Rental Act will apply. Guest(s) may be evicted under such procedures if Guest(s): (I) hold over in possession after Guest(s) tenancy has expired; (ii) commit a material breach of any provision of this Agreement that according to its terms would result in the termination of Guest(s) tenancy; (iii) fail to pay rent as required by this Agreement, or (iv) have obtained possession of the Premises by fraud or misrepresentation. Any reservation made under false pretenses will result in forfeiture of advance payments and the party will not be permitted to check-in. 

 INDEMNIFICATION AND HOLD HARMLESS – Guest(s) agree to indemnify and save harmless the Owner and Agent(s) for any liabilities, theft, damage, cost or expense whatsoever arising from or related to any claim or litigation which may arise out of or in connection with Guest(s) use and occupancy of the rental property including but not limited to any claim or liability for personal injury or damage or theft of property which is made, incurred or sustained by Guest(s). The terms “Agent(s)” and “Owner” as used in this Agreement shall include their heirs, successors in interest, assigns, employees, agents, and representatives where the context requires or permits. The terms “Guest(s),” “You,” and “Your” as used in this Agreement shall include Guest(s) heirs, successors, assigns, guests, invitees, representatives and other persons on the rental property during Guest(s) occupancy (without regard to whether such persons have authority under this Agreement to be upon the rental property), where the context requires or permits. 

 DISPUTES - This Agreement shall be governed by and interpreted in accordance with the laws of the State of Georgia, and shall be treated as though it were executed in the County of Gilmer, State of Georgia. Any action relating to this Agreement shall be instituted and prosecuted only in the Gilmer County Superior Court, Georgia. Guest(s) specifically consent to such jurisdiction and to extraterritorial service of process. 

 MOUNTAIN RESORT CABIN RESERVES THE RIGHT TO REFUSE SERVICE TO ANYONE - All rental properties are leased without regard to race, color, religion, sex, national origin or handicap. Due to liability issues, we are unable to provide prospective renters with keys to preview properties. 

 VIOLATING AGREEMENT - If Guest(s) violates any of the conditions of this Agreement; Owner(s) may terminate this Agreement and enter Premises. Upon notice of termination of this Agreement, Guest(s) shall vacate the Premises immediately and forfeit all rents and security deposits. 

 CREDIT CARD - I am providing my credit card number as a guarantee. I agree to pay all rent and/or any outstanding long distance phone charges, accept all terms of the lease agreement and accept all liability for any damage beyond normal wear and tear during the term of my lease with Mountain Resort Cabin. If I fail to do so I understand that these cost will be charged to my credit card and all credit card sales are final! 

 PLEASE READ, SIGN, COPY, AND RETURN ENTIRE CONTRACT WITHIN 3 DAYS! (FAX 954-442-3163) PLEASE INCLUDE ADDITIONAL GUEST INFORMATION AND SIGN BELOW AFTER READING AGREEMENT. ONLY REGISTERED GUESTS MAY OCCUPY THE PROPERTY.
